Overview & Synopsis

The advancement of Assisted Reproductive Technologies (ARTs) has greatly revolutionised reproductive rights, providing new opportunities for couples as well as individuals facing infertility. This paper explores Reproductive Rights and the constantly developing concept and usage of ARTs. It also examines how it has facilitated the realization of reproductive rights while also presenting novel ethical, legal, and socio-economic challenges. This work traces the historical development of reproductive rights both internationally and within Nigeria, while providing insights to the resultant perception on the use of ARTs. Using a doctrinal research methodology, this paper critically examines issues like the lack of legislation and guidelines, rights of children as well as some legal and ethical issues that arise as a result of the use of ARTs in Nigeria while also aiming to protect the reproductive rights of citizens. Findings reveal that the absence of comprehensive legislation creates significant legal uncertainty for stakeholders, including intended parents, donors, and medical practitioners. Additionally, the high cost of ARTs restricts access to only the wealthy, thereby undermining the fundamental right to reproduction. In conclusion, this paper emphasizes the urgent need for legislative intervention to regulate ARTs in Nigeria. It recommends the enactment of clear legal frameworks that safeguard reproductive rights, ensure equitable access, and address ethical concerns. Additionally, increased advocacy and public education are necessary to promote awareness and reduce the socio-cultural stigma associated with ARTs
