Tariff tensions and business fragility: towards a new mapping of insolvency risk
Overview & Synopsis
This article proposes a new mapping of insolvency risk in a context of tariff tensions and global reconfiguration. Through an interdisciplinary approach combining economics and insolvency law, it examines how tariffs operate as exogenous shocks that amplify internal vulnerabilities and generate financial stress relevant to the legal interpretation of corporate distress. The analysis shows that, although tariffs are not an autonomous cause of insolvency, they affect cost structures, access to credit, and supply‑chain stability, particularly in firms with fragile financial positions, delayed diagnostics, or governance deficiencies.
