Sentencing and Human Rights sets out to develop a systematic account of the importance of human rights principles at sentencing. Sentencing theory is dominated by discussion of the aims of punishment, but it is questionable whether the limits identified in the leading theories—principally the idea of proportionality or commensurability between the wrongdoing and the sentence—have served to constrain the sentencing decision in practice. It is argued that one reason for this is that insufficient attention has been paid to the special nature of state punishment as a process mediated by and through law. Punishment in the rule of law demands adherence to human rights principles, notably legality, proportionality, equality, and judicial responsibility for the determination of the sentence. Consideration of these principles provides the basis for an examination of the way in which they might be expected to limit important sentencing practices, such as the imposition of aggravated sentences for previous convictions, the treatment of confessions, and mandatory minimum sentences. This examination of the human rights limits on the sentence suggests that it might be necessary to reconsider the way in which state punishment is conceptualized in sentencing theory.

Although violent conflict has declined in northern Uganda, tensions and mistrust concerning land have increased. Residents try to deal with acquisitions by investors and exclusions from forests and wildlife reserves. Land wrangles among neighbours and relatives are widespread. The growing commodification of land challenges ideals of entrustment for future generations. Using extended case studies, collaborating researchers analyze the principles and practices that shape access to land. Contributors examine the multiplicity of land claims, the nature of transactions and the management of conflicts. They show how access to land is governed through intimate relations of gender, generation and belonging.

From the late eighteenth century, more and more men and women wanted to marry their cousins or in-laws. In this case, bridal couples had to apply for a papal dispensation and this meant a hurdled, lengthy and also expensive procedure. This book shows that applicants in four dioceses – Brixen, Chur, Salzburg and Trent – took very different paths through the thicket of bureaucracy to achieve their goal.

Neighbor-Homes: Julia Alvarez and Edwidge Danticat Write Hispaniola and the Diaspora analyzes the work of two of the most acclaimed contemporary American and Caribbean authors for the first time in a single book. Extending beyond scholarly approaches to home as a theoretical construct, Neighbor-Homes considers how Alvarez and Danticat inaugurate multiple spaces of belonging for their off- and on-island fictional characters, for their diverse community of readers, and for themselves. Revealing a more complex and complete understanding of these Hispaniola-rooted authors, the project places Alvarez and Danticat into conversation at a time when the construction of a border wall and racist immigration laws confirm increasing anti-Haitian sentiment in the Dominican Republic. Neighbor-Homes incorporates correspondence between the two writers to extrapolate diverse narrative representations of Hispaniola and to highlight various themes central to their work and social justice platforms including family relationships, community building, neighbor aesthetics, statelessness, and border solidarity. Neighbor-Homes will help interdisciplinary audiences read Danticat and Alvarez with a more critical eye so that they can more adeptly and profoundly understand Haiti, the Dominican Republic, and their respective diasporas. This important study is an essential read for students and scholars of literature and social justice, cultural studies, history, and politics, as well as Caribbean, Latinx, and African diaspora literatures.

Campus Medius explores and expands the possibilities of digital cartography in cultural and media studies. Simon Ganahl documents the development of the project from a historical case study to a mapping platform. Based on the question of what a media experience is, the concepts of the apparatus (dispositif) and the actor-network are translated into a data model. A time-space of twenty-four hours in Vienna in May 1933, marked by a so-called "Turks Deliverance Celebration" (Türkenbefreiungsfeier), serves as an empirical laboratory. This Austrofascist rally is mapped from multiple perspectives and woven into media-historical networks, spanning from the seventeenth century up to the present day.

To possess something is to lose something: Starting from this seemingly contradictory claim this essay invokes various registers to defamiliarize the ways in which property structures subjectivity, world relations and affects. Intertwined with colonialism, racism and sexism, concepts of property have found an echo in piracy and “postcolonial copyright.” At the level of theory, a crossing out and a reversal of time are required to undo property-related violence and its mindsets. At the level of artistic practice new modes of appropriation become imaginable. And while the commons will not be restored, multiple modes of having and commoning are possible.

'Thinking Literature across Continents' finds Ranjan Ghosh and J. Hillis Miller—two thinkers from different continents, cultures, training, and critical perspectives—debating and reflecting upon what literature is and why it matters. Ghosh and Miller do not attempt to formulate a joint theory of literature; rather, they allow their different backgrounds and lively disagreements to stimulate generative dialogue on poetry, world literature, pedagogy, and the ethics of literature. Addressing a varied literary context ranging from Victorian literature, Chinese literary criticism and philosophy, and continental philosophy to Sanskrit poetics and modern European literature, Ghosh offers a transnational theory of literature while Miller emphasizes the need to account for what a text says and how it says it. This book highlights two minds continually discovering new paths of communication and two literary and cultural traditions intersecting in productive and compelling ways.
